SUMMARY:
(REVISED AS OF 10/23/97 -- Passed House, amended)
Education Savings Act for Public and Private Schools - Amends the Internal Revenue Code (IRC) to permit tax-free
expenditures from education individual retirement accounts for elementary and secondary education expenses (including
tuition, special needs services, home schooling expenses, and transportation expenses) required for attendance at a public,
private, or religious school.
Increases, through December 31, 2002, the maximum annual amount of contributions permitted to such accounts.
Provides for the application of the IRC without regard to the result reached in the case of Schmidt Baking Company, Inc. v. Commissioner of Internal Revenue. Directs the Secretary of the Treasury to prescribe regulations reflecting such application of the IRC.
